Terms of Service
Last updated: 7 October 2026
These terms are an agreement between you and Shumin Kong, trading as ParkAhead ("ParkAhead", "we", "us"), a sole trader in New South Wales, Australia. They apply whenever you use parkahead.app, with or without an account. By creating an account or using the site you agree to them. Our Privacy Policy explains how we handle personal information.
Nothing in these terms takes away rights you have under the Australian Consumer Law (section 9).
These terms apply to new accounts from the date above. For existing accounts they apply 14 days after we email account holders about them; until then the previous terms apply.
1. What ParkAhead is
- ParkAhead shows live occupancy for Sydney's Park & Ride car parks and forecasts of when they fill. The live figures come from Transport for NSW; the forecasts come from our own statistical models.
- Live occupancy is free for everyone. Forecasts, such as arrive-by times and the next day's outlook, are part of ParkAhead Pro, our paid plan. The site shows which features are free and which are Pro; that split can change (section 7).
- If you have saved a car park, we may email you the evening before an unusual day there, when it is forecast to fill early or not at all. The setting is on your account page, and every alert has an unsubscribe link. Alerts are forecasts too (section 2).
- Features marked beta are still being worked on and may change or be withdrawn while we learn from them.
2. Forecasts are estimates
- A forecast is a prediction, not a promise. Forecasts can be wrong, late or missing, especially on unusual days: public and school holidays, disruptions, events and bad weather. The live figures from Transport for NSW can also be delayed or wrong.
- ParkAhead doesn't reserve spaces and doesn't guarantee that a space will be free when you arrive. It is no substitute for the signs and conditions at the car park.
- Use forecasts as one input to your plans, and never use the site while driving.
3. Your account
- You must be at least 16 to create an account. If you're under 18, a parent or guardian must agree to these terms for you.
- Give us accurate details and keep them up to date. Keep your password private, and email support@parkahead.app as soon as you think someone else has used your account; we may suspend sessions while we look into it. You're responsible for what people you let use your account do with it, and for loss caused by not keeping your password private. You're not responsible for unauthorised use caused by a failure on our side or our providers', or that you couldn't reasonably have known about.
- One account per person, please.
- You can close your account at any time by emailing support@parkahead.app from the account's email address. Any subscription is cancelled from the moment we receive your email, so no further payment is taken, and a payment taken after that is refunded. We close the account itself within 30 days. The Privacy Policy says what we keep afterwards.
4. Fair use
Please don't:
- query the site with automated tools, or at a rate, that burdens it for other people;
- resell, republish or redistribute our forecasts, or build them into another product;
- share your account or your Pro access with other people;
- try to reverse-engineer our models, or interfere with the site's security, availability or other users;
- use the site for anything unlawful.
We may suspend or close an account that breaks these rules. Where it's reasonable, we'll warn you first and give you a chance to put things right.
The live occupancy figures are Transport for NSW's data under a Creative Commons licence, and the map is OpenStreetMap's (section 8). Those licences let you reuse that data, whether you get it from them or see it here, and nothing in these rules limits what they allow. The rules above are about our forecasts, our site and automated access that burdens the service; Transport for NSW's Open Data Hub supplies the data in bulk.
5. Free trial
- Every new account gets ParkAhead Pro free for 14 days, counting the day you sign up. No card is needed.
- The trial ends at midnight, Sydney time, at the end of its 14th day. Nothing is charged. Your account simply becomes a free account, and Pro features lock until you subscribe.
- One trial per person. We may change or withdraw the trial for new accounts at any time; a trial already running is not affected.
6. ParkAhead Pro
- Plans and prices. Pro is a monthly or yearly subscription. Prices are in Australian dollars and are shown on your account page and at checkout before you pay; once you subscribe, Stripe's billing portal and your invoices show your plan and price.
- Payment. Stripe takes your payment by card at the start of each period. By subscribing you authorise these charges until you cancel.
- Subscribing during your free trial. Your free days carry on. Your first payment is taken on the day after your trial's last day, or at least 48 hours after you subscribe if less of the trial is left; checkout shows the exact date. Cancel before then and you won't be charged.
- Renewal. Your subscription renews automatically at the end of each period, at your plan's price, until you cancel.
- Cancelling. Cancel at any time from your account page: "Manage Subscription" opens Stripe's billing portal. If you can't get to it, email support@parkahead.app and we'll cancel for you. Your Pro access runs to the end of the period you've paid for and no further payments are taken. Until the period ends you can undo a cancellation, in the portal or by emailing us. We don't refund the rest of a cancelled period unless the refund rules below or the law say otherwise.
- Switching plans. You can switch between monthly and yearly in the billing portal. The new price applies from your next renewal. If you switch while your free trial is still running, the trial ends and the new plan is charged straight away.
- Failed payments. If a payment fails, your Pro access pauses while Stripe tries again, and resumes once a payment goes through. If the payment keeps failing, your subscription ends and your account becomes a free account.
- Price changes. We'll email you at least 30 days before a price change applies to you. If you don't want to pay the new price, cancel before it takes effect and you'll keep Pro at the old price until the end of your paid period.
- Refunds. Your rights under the Australian Consumer Law come first (section 9). Beyond those, we refund any amount we've charged by mistake, and we may refund in other cases at our discretion. Email support@parkahead.app.
- Promotions and free access. We may offer promotion codes, on the conditions stated with each offer. We sometimes give accounts free Pro access, for example to testers; we may withdraw it, with notice.
7. Changes to the service
- ParkAhead is small and new, and we change it often: features, forecasts, the design, and what is free and what is Pro.
- If we withdraw or materially cut back something you paid for, such as forecasts or alerts, or stop ParkAhead altogether, we'll email you at least 14 days beforehand. You can then cancel and we'll refund the unused part of the period you've paid for, and if we stop the service we refund it anyway. Everyday improvements, and changes to beta features that aren't sold as part of Pro, aren't cutbacks.
- We try to keep the site up, but we don't promise uninterrupted service. When something breaks, we fix it as quickly as we can.
8. Content and data
- The site, its design, our forecasts and models, and the ParkAhead name belong to us. You may use the site for your own personal, non-commercial purposes.
- Live occupancy data is © Transport for NSW, published on its Open Data Hub under the Creative Commons Attribution 4.0 licence. Map data is © OpenStreetMap contributors. Those licences are theirs, not ours, and nothing in these terms limits the rights they give you to that data, whether you get it from them or see it on ParkAhead.
- ParkAhead is an independent service. Transport for NSW does not endorse it.
9. Consumer guarantees and liability
- Your rights. Our services come with guarantees that cannot be excluded under the Australian Consumer Law, including that they are provided with due care and skill. Nothing in these terms excludes, restricts or modifies those guarantees, or any other right the law gives you that cannot be excluded.
- What we are responsible for. If we break these terms or are negligent, we're liable for the loss that was a reasonably foreseeable result, subject to the limit below.
- What we're not responsible for. Forecasts are estimates (section 2), so to the extent the law allows we're not liable for loss that comes from a forecast or a live figure being wrong, such as a full car park, a missed train, fines, fuel or time, unless it was caused by our breach of these terms or our negligence; nor for Transport for NSW's data being wrong or late, nor for loss that neither of us could reasonably have foreseen.
- Limit. To the extent the law allows, our total liability to you for everything connected with ParkAhead is limited to the amount you paid us in the 12 months before the event you claim about. This limit doesn't apply to death or personal injury caused by our negligence, to fraud, to a breach by us of our privacy or security obligations to you, or to anything the law doesn't let us limit.
- Your responsibility. You stay responsible for driving safely and for obeying the rules and signs at the car park.
10. Ending this agreement
- You can stop using ParkAhead at any time and close your account (section 3).
- We may suspend or close your account if you break these terms (section 4), or if we have to for legal or security reasons. If we suspend it for security, we'll tell you when we can, look into it promptly, and refund or credit any paid period you lose. Whenever we close an account for a reason other than your material breach of these terms, we refund the unused part of any period you've paid for, unless the law stops us.
11. Changes to these terms
- We may update these terms; the date at the top shows when. We'll email account holders at least 14 days before a change that matters takes effect, and explain what changed.
- If you don't agree with a change, close your account or cancel your subscription before it takes effect. Using the site after that date means you accept the new terms. A change never reduces what you've already paid for in the current period.
12. General
- These terms are governed by the laws of New South Wales, Australia. You can bring a dispute to the courts there. Your right to use consumer bodies such as NSW Fair Trading or the ACCC is unaffected.
- If part of these terms turns out to be invalid, the rest still applies.
- These terms and the Privacy Policy are the whole agreement between you and us about ParkAhead.
- If ParkAhead is sold or transferred, we may pass this agreement to the new owner, and we will tell you.
